The place is really packed but will probably thin out a lot tomorrow. Kids don't go back to school for another week but adults have to work. Not quite sure why the Aquarium is popular for swimming because you dodge coral, it's shallow and too many sting rays. Still very few facilities and no restaurants or stores.

Tenacatita open for the holidays
Please come and enjoy the beaches of Tenacatita. Bring your shade umbrellas and tents for camping. The road is open for access and you will not be bothered by private security guards as in the past.The governor of Jalisco, Aristotles Sandoval has guaranteed you a safe visit and has provided security by state police. If you encounter any problems from the few private security guards, please inform the state police. At this time construction of any type even palapas are not allowed. This may change in the new year. Also, bring your own sanitation and toilets as these are limited.

It's open and still very pretty. Only two State Police and no hired guns like the last 4-5 years. People are camping across the hill by the Aquarium. It's still bring your own everything and bathroom facilities are basic.

Hola Amigos de Tenacatita,
With a campaign promise the governor of Jalisco sent in his troops today to liberate Tenacatita beaches and provide free access and open camping. The state police remain to ensure the safety of citizens and tourists. The last three years have provided proof of allegations against Rodenas Corporation and hired security. Controlling public use by intimidation with guns and riot dogs including the blatant attempts of restricting beach access, limitations of camping and road closures were all cited.
The liberation breathes an air of hope for the recently ravaged community from hurricane Patricia. Slowly aid helps to rebuild. But it is a process of wait and see.
Tenacatita has always provided the life blood to this community with tourism and the employment for many . As with this struggle, the road back is a slow uphill climb.
Those of you that have recently contributed will help to rebuild for many hardest hit.Ann helping schools where needed and in lost supplies. Donations have come in for helping the children and mothers. We plan on a Christmas celebration where every child will receive a gift bag from Santa.

On the beaches around the country they began to place apocalyptic signs: "Private property, no trespassing". Fishermen, villagers, shopkeepers and families begin to be displaced from their own land. They are treated as foreigners in their country, undesirable strangers, visual pollution unbearable for exclusive international hotels.
Since 1986 Mayan descendants of the indigenous rebels of the Caste War ran out of beach in the biosphere reserve of Sian Ka'an, marginalized of the tourist project of the Riviera Maya driven by the then Governor Pedro Joaquin Coldwell, now secretary Energy of the federal administration. In Jalisco, a study by the National Regeneration Movement warned that 82 percent of the 280 kilometers of coastline is being privatized. In October 2010, the rightful owners of 42 acres of beachfront Tenacatita, in that state, were stripped of their land because a judge granted a particular area. And last August, fishermen from the town of La Huerta, in that entity, were cast from the beach by private guards of a resort. And what of Guerrero, where the ejidatarios Revolcadero, Copacabana and La Zanja were faded to give way to Punta Diamante complex. Five stamps National exodus ahead.

Public goods are not trinkets to be offered to the highest bidder. The privatization of the beaches is a continuation of the course of the country: an elite with excessive ambitions malbaratar able to change an entire nation to live like Hollywood stars.
Instead of remaining as spectators of looting more than the rest of Mexico, it is essential that at least we join the campaign to not become foreigners in our own country.

The dream of Rodenas and Villalobos
Where do land grabbing developers in Mexico get off with Photoshop versions of their resorts and promising they will be open in a few months. Saxaa A3 resorts has been doing it for four years while knowing full well there is a legal dispute over most of the property in Tenacacita. I've seen the Photoshopping on other developments in our area but this one is especially important due to Rodenas and Villalobos stealing the land, destroying businesses and very possibly the lives of the people of Rebalsito and Tenacatita. I hope this POS never happens

Today the goons told Chely she couldn't go to work in her restaurant because they own the sidewalk and she can't cross it. Politics are everywhere right now, before the elections on June 7. It didn't make me feel very good to see Emilio Marquez (ex-governador of Jalisco, best buddies with Villalobos) supporting Enrique Alfaro. And here I thought Movimiento Ciudadano was going to be different. How naive....

Tenacatita really open?
Lots of excitement over Semana Santa with the Military and Federales telling the "rent-a-cops" to take a hike and don't bother anyone using the beach or area for the vacation weeks. Upwards of three thousand people were reported on the beach the first week of Semana Santa. Not sure how sanitary it is with no facilities but nobody seemed worried. We'll see next week if the rent-a-cops come back like before but the rumor is the beach will remain open.

Tenacatita not quite open

Unfortunately last night the gate to Playa Mora went up again and people who were planning to have a campfire on the beach to bring in the New Year were not allowed. But the marina will be back (if they haven't been already)and right now Villalobos' security guards are in violation of a federal order. Due to the holidays, there are less personnel in government offices and less police available, so it may take a few days. By the time I left around noon, some cars were able to drive over to Playa Mora, unload people, ice chests, etc. and then bring the vehicle back over to the other side to park.
Although some people have won their lawsuits and have been given their property back, they haven't been able to take possession. These are all outside of the 42 hectares.
Until the issue of the concession is settled, nothing can happen on the beach in terms of restaurants, businesses, etc. Hopefully that will be resolved soon.
A representative of PROFEPA (the judicial arm of SEMARNAT - the "environmental protection agency") went to the beach a week or so ago, undercover, and experienced first hand how the security guards try to intimidate people. They reported back that there in fact wasn't free access to the zona federal, that the beach wasn't open 24 hours a day, and that the guards were very disrespectful and were overstepping their bounds.
One of the first things the marina did was take all the weapons from the guards except for two who have legal permits for their pistols.
Having PROFEPA step up for real, finally, is very heartening. A positive way to start the new year.

Happy New Year to Tenacatita- the president of La Huerta along with the Marines (navy) opened all access to Tenacatita. For the first time in over 4 yrs. one can drive to playa Mora, down beach road and 24 hr. access to beaches . Let the party begin

Yesterday Bette and I asked someone in the know if there was any new news on the situation in Tena as I heard the president of the municipio was around, and he doesn't come around very often. The person winked at me and said "banate ahi en Tenacatia alredador de las 11 en la mañana." I was pretty sure something good was going to happen, but not quite sure what. When Bette and I arrived at the beach, about 11:15, we met with Chile, Norm and Vi. We had given Chile a heads up about what we heard and he had gotten there on time, and at that time there was nothing new. We arrived a little late and when we arrived there were armed soldiers present from the Marina. Anyway, I said Bette and I are going to see if we can't take a walk down the 4 year closed road and see what they say. I asked one of the corporate guards if we could take a walk down the road and he told me as always that I couldn't, only on the beach. I ignored him and asked one of the Marina (federal Mexican Navy guys) if I could take a walk down the road, and he said "Si señor, todo la playa y el camino es libre, es zona Federal y es abierto al publico". Well my feet, that had know every pebble on that road for 35 years and hadn't been allowed to stub a toe on any of those rocks for the last five said "Please give a good stubbing." The five of us took a walk down the road and let me tell you, it was sabrosisimo. When we were walking, some ejido members were driving down in a truck, another first. Upon return some members of the Ejido informed us that they opened the gate to playa Mora and had sent someone for hacksaws and wrecking bars to remove it permanently and suggested that as tourists, it would be a good idea to drive over to Mora in my truck. The five of us loaded up and away we went con rumbo a playa Mora. When we got to the kiosk where one of the corporate guards, whose vocabulary consisted only of the word "NO" for 4 years, stopped us, I said we are going to playa Mora. Instead of "NO"' he said"Pasa te jefe". This is hot off the presses and there will be more coming, but one thing I can tell you is that we'll be celebrating New Year's Eve on Tenacatita beach, where nobody will fck with us! Big time THANKS go to the tough and tenacious people of Rebasito who never gave up in a David and Goliath fight.

Playa La Boca
We've heard of Playa La Boca before but never been there. Some people were promoting it as a Tenacatita replacement but I'm afraid it doesn't come close. The promotion was more to support the 2 families from Rebalsito who opened restaurants there. The beach is pretty but not swim-able due to it's open ocean with large waves.
It's a long bumpy ride after turning right on just about any Rebalsito street. You pass the cemetery which is on the beach and continue another 1/2 mile. We had a beer at the one remaining restaurant and then walked out to the point and river mouth. It's the mouth of the Rio Purificación which is only open to the ocean during the rainy season. It was still open this weekend.
The river mouth is at the southern edge of Playa Tecuan and when not much water would be an easy access point since Tecuan is closed from the highway. The Shangri La property of Tecuan is overlooking the river.

An amazing turn of events. Unbeknownst to almost everyone, representatives of the governor's office, the Julian, the president of La Huerta, accompanied by lots of people and several truckloads of State Police (what a switch to have them on our side), came yesterday and after showing an order, began to dismantle the gate and tear down the guard shack. Several people from town helped while everyone else waited at Chito's restaurant where Julian asked us to stay until all the debris was cleared so no one would get hurt.
Obviously the other side must have known what was going to happen because they accepted it and many gathered their stuff and left.
Julian spoke to the crowd that had gathered at Chito's and explained that the concession at this time is only for a free beach, recreation and a malecon. For now no camping and no commercial use. Also people need to be responsible for their trash, and not bring lots of booze. There are still many details to be worked out. Yesterday cars had to park at the glorieta (the entrance ) but Julian asked for us to walk if we could since there were so many people.
What a glorious afternoon. Kids playing in the waves, families hanging out, big smiles on everyone's faces. This is just the beginning and just about the federal zone. The land disputes still haven't been resolved and so Rodenas' security people are guarding "their" part.

LIBERAN ACCESO A PLAYA DE TENACATITA TRAS DOS AÑOS Y 10 MESES DE BLOQUEO

Este domingo, autoridades estatales liberaron el acceso a la playa de Tenacatita, luego de dos años y 10 meses en los que estuvo bloqueado el paso –tomando un tramo de la carretera federal 200– por parte del empresario José María Andrés Villalobos y apoyado en su momento por la administración de Emilio González Márquez.
A las 10 horas de ayer, el gobierno estatal concentró a su personal en Melaque, lugar desde donde se trasladaron por tierra hasta la playa de Tenacatita, en el municipio de La Huerta. Ahí procedieron a liberar el ingreso de la carretera número 200, Barra de Navidad-Puerto Vallarta, en el kilómetro 7 del ramal Tenacatita.
De acuerdo con información del gobierno del estado, el operativo transcurrió sin incidentes.
“Los agentes notificaron al personal de seguridad que se encontraba en la garita de acceso que a partir de ese momento se liberaba el acceso carretero, con independencia de los procedimientos legales que existen”, señala el comunicado del gobierno de Jalisco. “Los agentes procedieron a quitar la garita, las barreras y alambrado del lugar”.
A las 15:30 horas, el ingreso y el derecho de paso quedaron liberados, luego de la obstrucción impuesta el 4 de agosto de 2010.
El comunicado añade que el alcalde de La Huerta, Jesús Julián de Niz Sánchez, firmó un documento compromiso en el que se establece que no otorgará ningun tipo de licencia, autorización o permiso en la zona federal marítima terrestre.
Hasta la noche de ayer, el gobierno del estado no informó sobre las repercusiones jurídicas para Andrés Villalobos, quien, con apoyo del ex gobernador Emilio González Márquez, además de mantener la obstrucción de la vía federal –lo cual es calificado como delito–, cometió una serie de desacatos a resoluciones del Tribunal de lo Administrativo del Estado (TAE), hecho que también se debe sancionar.
En campaña, el gobernador Aristóteles Sandoval Díaz prometió resolver el problema de Tenacatita y liberar la bahía el primer día de su gobierno. Fue hasta el 24 de mayo cuando Sandoval Díaz regresó a la zona para realizar la instalación de la Junta Intermunicipal de Medio Ambiente de la Costa Sur, en La Huerta. Ahí prometió que se instalarían mesas de diálogo para abrir la playa, lo que no agradó a vecinos desalojados por Andrés Villalobos y derivó en una serie de reclamos.
Al finalizar el evento se acercó un lugareño, Fausto Robles, quien le recordó al mandatario su promesa de abrir la playa en los primeros días de su gobierno, habiendo pasado ya tres meses. El gobernador argumentó que elementos jurídicos obstaculizaban la resolución del problema.
“Yo le contesté que no, que era una playa pública, un bien de la nación y que debe estar abierta y no secuestrada, y está secuestrada y eso es un delito federal. Esto es un tema político”, declaró ese día Fausto Robles a medios de comunicación.
En reacción a estos reclamos y a fin de cumplir su promesa, Sandoval Díaz ordenó al secretario general de Gobierno, Arturo Zamora Jiménez, y a uno de sus colaboradores más cercanos, Alberto Lamas, sostener una reunión con los afectados por el cierre de la playa.
Ésta se concreto el miércoles pasado, durante la cual, según Zamora Jiménez, los pobladores sólo exigieron la liberación de la bahía. La contraparte no estuvo presente en dicha reunión; aunque el 14 de marzo de este año, durante el cambio de la Mesa Directiva de la Cámara Nacional de Comercio (Canaco) de Guadalajara, se encontraron Sandoval Díaz y Andrés Villalobos, quienes estuvieron juntos todo el evento.
La bahía de Tenacatita fue “secuestrada” luego de que la madrugada del 4 de agosto de 2010, 150 policías estatales arribaran de manera sorpresiva a la zona para expulsar violentamente a los habitantes del lugar con base en una orden de desalojo emitida por el juez de Cihuatlán, Victoriano González

Tenacatita Update 5/13/13

After months with no news, there has finally been some forward movement. On May 8, 2 members of the Rebalsito ejido and fishing cooperative, along with several lawyers and associates, went to Mexico City and filed a denuncia (formal complaint) with the Attorney General’s office relating to the events that took place on August 4, 2010 when the beach was taken over and everyone was forced to leave their homes and businesses. It also included events that happened later that night, when drunk security police came into town and terrorized people, shooting guns into the air as well as firing rubber bullets, storming into houses and roughing people up (including minors and an elderly man). Other federal offences, like cutting the mangroves, were also noted.
Individual denuncias were filed with the county shortly after August 4, but never went anywhere. It was obvious what side the government was on. Meetings with state and federal officials (when they happened) were a sham. The fact that the denuncia filed last week was accepted is a good thing. Hopefully this time the charges will be investigated and the papers won’t languish in the desk of some bureaucrat.
The other positive news is that SEMARNAT (the environmental agency) won the amparo filed by Rodenas regarding the concession. To briefly review, Rodenas’ concession (the right to use federal property, in this case, Tenacatita beach) came up for renewal in 2012 and SEMARNAT refused to renew their permit. Then SEMARNAT gave the concession to the municipality of La Huerta. Rodenas filed an amparo (similar to an injunction) against La Huerta and SEMARNAT which has prevented La Huerta from taking possession. Although SEMARNAT won, the case still has to go through a review, and then a final decision is made. Usually whoever wins the case, wins the review because the decision can only change if new information is introduced, but this is not always the case.
