The Aquarium</div>

The place is really packed but will probably thin out a lot tomorrow. Kids don't go back to school for another week but adults have to work. Not quite sure why the <span style="text-align: center;">Aquarium is popular for swimming because you dodge coral, it's shallow and too many sting rays. Still very few facilities and no restaurants or stores.</span></div>

With a campaign promise the governor of Jalisco sent in his troops today to liberate Tenacatita beaches and provide free access and open camping. The state police remain to ensure the safety of citizens and tourists. The last three years have provided proof of allegations against Rodenas Corporation and hired security. Controlling public use by intimidation with guns and riot dogs including the blatant attempts of restricting beach access, limitations of camping and road closures were all cited.</div>

The liberation breathes an air of hope for the recently ravaged community from hurricane Patricia. Slowly aid helps to rebuild. But it is a process of wait and see.</div>

Saxaa A3 resorts has been doing it for four years while knowing full well there is a legal dispute over most of the property in Tenacacita. I've seen the Photoshopping on other developments in our area but this one is especially important due to Rodenas and Villalobos stealing the land, destroying businesses and very possibly the lives of the people of Rebalsito and Tenacatita. Lots of excitement over Semana Santa with the Military and Federales telling the "rent-a-cops" to take a hike and don't bother anyone using the beach or area for the vacation weeks. Upwards of three thousand people were reported on the beach the first week of Semana Santa. Not sure how sanitary it is with no facilities but nobody seemed worried. We'll see next week if the rent-a-cops come back like before but the rumor is the beach will remain open.</div>

Unfortunately last night the gate to Playa Mora went up again and people who were planning to have a campfire on the beach to bring in the New Year were not allowed. But the marina will be back (if they haven't been already)and right now Villalobos' security guards are in violation of a federal order. Due to the holidays, there are less personnel in government offices and less police available, so it may take a few days. By the time I left around noon, some cars were able to drive over to Playa Mora, unload people, ice chests, etc. and then bring the vehicle back over to the other side to park. </div>

Although some people have won their lawsuits and have been given their property back, they haven't been able to take possession. These are all outside of the 42 hectares. </div>

A representative of PROFEPA (the judicial arm of SEMARNAT - the "environmental protection agency") went to the beach a week or so ago, undercover, and experienced first hand how the security guards try to intimidate people. They reported back that there in fact wasn't free access to the zona federal, that the beach wasn't open 24 hours a day, and that the guards were very disrespectful and were overstepping their bounds. </div>

<i>Yesterday Bette and I asked someone in the know if there was any new news on the situation in Tena as I heard the president of the municipio was around, and he doesn't come around very often. The person winked at me and said "banate ahi en Tenacatia alredador de las 11 en la mañana." I was pretty sure something good was going to happen, but not quite sure what. When Bette and I arrived at the beach, about 11:15, we met with Chile, Norm and Vi. We had given Chile a heads up about what we heard and he had gotten there on time, and at that time there was nothing new. We arrived a little late and when we arrived there were armed soldiers present from the Marina. Anyway, I said Bette and I are going to see if we can't take a walk down the 4 year closed road and see what they say. I asked one of the corporate guards if we could take a walk down the road and he told me as always that I couldn't, only on the beach. I ignored him and asked one of the Marina (federal Mexican Navy guys) if I could take a walk down the road, and he said "Si señor, todo la playa y el camino es libre, es zona Federal y es abierto al publico". Well my feet, that had know every pebble on that road for 35 years and hadn't been allowed to stub a toe on any of those rocks for the last five said "Please give a good stubbing." The five of us took a walk down the road and let me tell you, it was sabrosisimo. When we were walking, some ejido members were driving down in a truck, another first. Upon return some members of the Ejido informed us that they opened the gate to playa Mora and had sent someone for hacksaws and wrecking bars to remove it permanently and suggested that as tourists, it would be a good idea to drive over to Mora in my truck. The five of us loaded up and away we went con rumbo a playa Mora. When we got to the kiosk where one of the corporate guards, whose vocabulary consisted only of the word "NO" for 4 years, stopped us, I said we are going to playa Mora. Instead of "NO"' he said"Pasa te jefe". This is hot off the presses and there will be more coming, but one thing I can tell you is that we'll be celebrating New Year's Eve on Tenacatita beach, where nobody will fck with us! Big time THANKS go to the tough and tenacious people of Rebasito who never gave up in a David and Goliath fight.</i></div>

The Good News – Lino, a member of the ejido and owner of the historic Hotel Frances in Guadalajara has won his case for 5 of his lots on the hill to Playa Mora (the snorkeling beach). He was able to fence 3 hectares (7.5 acres). This is a major advance, as the other 4 who won hadn’t been allowed (by the “private” state police) to fence their lots, although they have a judicial order to do so. These lots are outside the 42 hectares of Rodenas’ original claim. As of now, access to Playa Mora is still by walking around the rocks at low tide. </div>

Francisco, the lawyer who’s working to help the restaurant owners recoup some of their losses, is filing a queja (a type of lawsuit) which will cover all of the lots that are outside the 42 hectares, (maybe as many as 100 lots) that Rodenas has taken possession of illegally. Some of you might remember that a couple of years ago another lawyer, Everardo Rojas won a similar queja, but after going through revision, the decision was reversed. Apparently it was denied because it included all of the land that Rodenas took, including the lots within the 42 hectares. That’s a separate case and is still in process. </div>

There was a meeting at Chito’s restaurant last week where people decided to invite Julian, the president (head) of the municipality of La Huerta, to come to El Rebalsito and talk to people about what’s happening with the beach. People are asking for the right to be vendedores ambulantes (walking beach vendors) in the federal zone. Also included in the email invitation was a request that Francisco (the lawyer) be given access to all the files relating to the concession so he can keep us up to date as to what’s happening. </div>

The Not So Good News – The issue of the concession still has not been resolved, and now the decision has been suspended. There was no reason given. So nobody has the concession, neither Rodenas nor La Huerta. </div>

There were a couple of busy days on the beach and in town during Semana Santa, but that was it. Some of the tour buses that come out to the beach only stay for a short time due to the lack of bathrooms. The municipality has tried to bring in portable toilets, but wasn’t allowed. Crazy. </div>

Thanks to Santa Claus, we have another laptop to give to the top middle school graduate this July. This will be the 5th one. </div>

Many of the jobs in Mexico now require la prepa (high school) whereas before, la secundaria (middle school) was sufficient. Unfortunately la prepa isn’t free – costs about 600 pesos ($50 US) a semester. Certain books have to be bought, or shared. There’s no public transporation to the nearest prepa here in Miguel Hidalgo, and it’s too far to walk, so the students have to chip in for gas and get someone to take them, or try to hitchhike. </div>

I’d love to figure out a way to help some of these kids who are really motivated and doing well in school (prepa requires and entrance exam) to be able to continue their education, especially if they come from families that can’t afford to pay for them. When the restaurants on the beach were open, the kids could work vacations and make some money. But now there aren’t many jobs to be had. </div>

If anyone has any ideas or suggestions as to how to raise some money for this, please let me know. Everyone has been very generous in responding to different needs of the community, but I hate to keep asking for money, even if it’s not for me! Education is so important, not just the book learning part of it, but getting out, being around different people, getting exposed to new ideas, seeing a bigger picture ; it gives someone more options. </div>

We've heard of Playa La Boca before but never been there. Some people were promoting it as a Tenacatita replacement but I'm afraid it doesn't come close. The promotion was more to support the 2 families from Rebalsito who opened restaurants there. The beach is pretty but not swim-able due to it's open ocean with large waves.

It's a long bumpy ride after turning right on just about any Rebalsito street. You pass the cemetery which is on the beach and continue another 1/2 mile. We had a beer at the one remaining restaurant and then walked out to the point and river mouth. It's the mouth of the Rio Purificación which is only open to the ocean during the rainy season. It was still open this weekend.

Following the opening of access to Tenacatita Bay last Sunday, the 54 merchants and 18 fishermen who were evicted from the beach in 2010, are seeking to be authorized to return and operate.</div>

An amazing turn of events. Unbeknownst to almost everyone, representatives of the governor's office, the Julian, the president of La Huerta, accompanied by lots of people and several truckloads of State Police (what a switch to have them on our side), came yesterday and after showing an order, began to dismantle the gate and tear down the guard shack. Several people from town helped while everyone else waited at Chito's restaurant where Julian asked us to stay until all the debris was cleared so no one would get hurt. </div>

Obviously the other side must have known what was going to happen because they accepted it and many gathered their stuff and left. </div>

Julian spoke to the crowd that had gathered at Chito's and explained that the concession at this time is only for a free beach, recreation and a malecon. For now no camping and no commercial use. Also people need to be responsible for their trash, and not bring lots of booze. There are still many details to be worked out. Yesterday cars had to park at the glorieta (the entrance ) but Julian asked for us to walk if we could since there were so many people. </div>

What a glorious afternoon. Kids playing in the waves, families hanging out, big smiles on everyone's faces. This is just the beginning and just about the federal zone. The land disputes still haven't been resolved and so Rodenas' security people are guarding "their" part.<br />

Ahí prometió que se instalarían mesas de diálogo para abrir la playa, lo que no agradó a vecinos desalojados por Andrés Villalobos y derivó en una serie de reclamos.</span></div>

After months with no news, there has finally been some forward movement. On May 8, 2 members of the Rebalsito ejido and fishing cooperative, along with several lawyers and associates, went to Mexico City and filed a denuncia (formal complaint) with the Attorney General’s office relating to the events that took place on August 4, 2010 when the beach was taken over and everyone was forced to leave their homes and businesses. It also included events that happened later that night, when drunk security police came into town and terrorized people, shooting guns into the air as well as firing rubber bullets, storming into houses and roughing people up (including minors and an elderly man). Other federal offences, like cutting the mangroves, were also noted. </div>

Individual denuncias were filed with the county shortly after August 4, but never went anywhere. It was obvious what side the government was on. Meetings with state and federal officials (when they happened) were a sham. The fact that the denuncia filed last week was accepted is a good thing. Hopefully this time the charges will be investigated and the papers won’t languish in the desk of some bureaucrat. </div>

The other positive news is that SEMARNAT (the environmental agency) won the amparo filed by Rodenas regarding the concession. To briefly review, Rodenas’ concession (the right to use federal property, in this case, Tenacatita beach) came up for renewal in 2012 and SEMARNAT refused to renew their permit. Then SEMARNAT gave the concession to the municipality of La Huerta. Rodenas filed an amparo (similar to an injunction) against La Huerta and SEMARNAT which has prevented La Huerta from taking possession. Although SEMARNAT won, the case still has to go through a review, and then a final decision is made. Usually whoever wins the case, wins the review because the decision can only change if new information is introduced, but this is not always the case. </div>

The Jalisco coast had remained pristine until 1944, halfway through the twentieth century, when the state governor, General Marcelino García Barragán, introduced an initiative called Marcha hacia el mar (“March to the Sea”). García Barragán had a road built from Guadalajara to Melaque, to allow ranchers to settle that part of Jalisco. He himself claimed ownership of a beach called El Tecuán. The story of the coastal colonization he initiated would later become the subject of Agustín Yáñez’s novel La tierra pródiga (“The Prodigal Land”), written in the late 1950s, during the years that Yáñez himself served as governor of Jalisco.</div>

In his novel, Yáñez reflected on the natural resources of the state’s coastal regions, which had been monopolized by lumber companies, land usurpers, cattle thieves and horse thieves. He was very skeptical about colonization, after seeing the destruction that the March to the Sea had caused in Melaque: “Heavy equipment kept arriving […] advancing heavily, slowly, inexorably. They tore down trees, broke down mountains, filled abysses. […] Monstrous tractors, gigantic bulldozers, colossal scrapers and enormous dump trucks. They came from the East, the North, the South, marching toward the sea.” Yáñez’s world was peopled with fascinating, crooked caciques (land owners) such as El Amarillo, the novel’s main character, based on Rodolfo Paz Vizcaíno, owner of Tenacatita ranch. Guillermo Gargollo knew him well. “The legend (of his own fabrication) has it that he was a brutal man, who had killed many people. Later, I realized it wasn’t true, but still, we were scared of him.”</div>

On one of Gargollo’s trips to the coast, he discovered that Paz Vizcaíno had stolen their equipment in Cuixmala in order to build access roads to the beaches in Tenacatita. He built a hotel there and named it Los Ángeles Locos . Paz Vizcaíno had always been a fortunate man, but he never had the chance to stay at that hotel, and ended up losing it along with the rest of his properties, which were repossessed after he was charged with fraud involving the Banco Regional de Crédito de Occidente. The story did not end well: he was sent to prison, and then to a mental hospital, or so they say.</div>
